Renting properties by foreign citizens in Romania
In recent years, our country has attracted an increasing number of foreign investors and expats who choose to live here for shorter or longer periods.
This trend has led to an increased demand for rental properties for those who do not own properties in Romania.
If you are a property owner who wishes to rent your property to a foreign citizen, there are some important aspects to consider. Here’s what you need to know:
Rules for renting properties to foreign citizens Foreign citizens who wish to rent a property in Romania must have a valid visa or residence permit in Romania in order to rent a property.
The lease agreement: it is very important to have a well-drafted and structured lease agreement that specifies all the terms and conditions of the rental of that property.
The contract must be drafted in Romanian and English, or another language if requested by the client, and must include all the information that is the subject of the contract, such as the address of the property, the duration of the rental, the rent amount, the date on which the rent will be paid, the account to which payment will be made, etc.
The security deposit: when renting a property to a foreign citizen and not only, it is recommended to request a security deposit that can be equal to the equivalent of one month’s rent.
This will help you cover any damages caused by the tenant during the rental period in your property.
Public services and maintenance: these services are not included in the rent price and must be paid separately by the tenant (electricity, gas, TV, internet, etc.).
You must be clear with the tenant regarding what is included and what is not included in the rental price, and specify this in the contract.
Taxation of rental properties: as a property owner, you must comply with all fiscal obligations provided by Romanian law. Revenues generated from the rental of properties are taxed in Romania and you must be registered as a natural or legal person engaged in economic activities in this regard and pay taxes.
